Jiffynet Hosting is dedicated to providing an all-round quality service. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers whilst at the same time satisfying our legal and ethical responsibilities.

Failure to follow any term or condition will be grounds for immediate account deactivation without notice. Jiffynet Hosting will be the sole arbiter as to what constitutes a violation of any of these provisions.

Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.

JiffyNet Hosting provides services to clients all around the world. JiffyNet Hosting has the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to insure these services.

Content:
All services provided by JiffyNet Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless JiffyNet Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography - Due to legal and social issues, we will not accept any new customers who publish child pornographic images. We do not allow any child pornographic content on our server, including but not limited to photographs of nude children, explicit language, or sexual fiction. If an existing customer publishes child pornographic images, Jiffynet Hosting will suspend and cancel your account.

Let's make this easy to understand:
No site that promotes child porn or nudity will be allowed on our servers, this includes BANNERS, CLICKER SITES, EDITORIALS, STORIES, NUDE PHOTOGRAPHS OF CHILDREN, EXPLICIT LANGUAGE, SEXUAL FICTION, OR ANYTHING THAT JIFFYNET HOSTING DEEMS INAPPROPRIATE FOR OUR SERVERS. If an existing customer publishes child pornographic images, Jiffynet Hosting will remove the site from our server without notice and all monies paid will be forfeited.

Non-acceptable content, links and websites

• Pirated software
• "Illegal MP3's"
• Hacker and Cracker programs, Websites or archives
• Child Pornography
• Emails promoting child pornography

Warez Sites/Hacking Cracking Sites:
Warez Sites are sites that are typically used by "hackers" to trade (upload/download) illegally pirated copies of software programs with one another. Jiffynet Hosting has a zero-tolerance policy on all Warez Sites. Sites that become a trading post for "warez" programs will be reported to any and all regulatory, administrative, and/or governmental authorities for prosecution. In addition to your account being deleted from our servers, you may face legal action that can be taken against you by the programmers/software companies of the copyrighted software.

JiffyNet Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Excessive CPU usage - Customers will not be allowed to use excessive amounts of CPU processing on any of our servers. Such action is grounds for immediate suspension. For example:

1) Personal customers cannot give away, sell or resell our counters or auto-responders to the rest of the world which caused an excessive amount of requests on our server(s).
2) Email bombs.
3) Reselling CGI access to other 3rd parties
4) IRC Daemons, are strictly prohibited
5) Other activities, whether lawful or unlawful, that we determine to be harmful to our subscribers, operations, or reputation, including activities that restrict or inhibit any other user from using and enjoying the service or the Internet.
6) Spam, or Unsolicited Mail Submissions- NO DOMAIN MAINTAINED BY Jiffynet Hosting will be permitted to submit Spam or Unsolicited email of any type. The sending of Spam or unsolicited email using our email server.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. Jiffynet Hosting may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available, Jiffynet Hosting reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

If we receive a complaint on Spam or Unsolicited email from a Domain maintained on our servers, the account will be subject to suspension and/or cancellation without notice.

To maintain the integrity of our service the following limitations apply:

Sites running large chat room gatherings.

JiffyNet Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms:
JiffyNet Hosting does allow clients to install chat rooms, these can be found in the control panel. However, these tend to be large system hogs and may fall into the usage limitations policy (see above). We do not allow the installation of your own chatroom scripts.

Background Processes/Programs
JiffyNet Hosting may allow programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incured based on system resources used and operational maintenance needed.

Cron Jobs:
JiffyNet Hosting does allow Cron Jobs to be conducted on our servers.

IRC's:
JiffyNet Hosting currently does not allow IRC, IRC bots, eggdrops, BitchX, psyBNC to be operated on our servers. This includes, but is not limited to, IRC bots (eggdrop, energymech, etc.), IRC servers, and IRC bouncers (bnc, psybnc, etc.) Customers also must not store copies of this software on our servers. Anybody caught using such software or having such software stored in any of their directories will have their accounts immediately disabled without prior notice. This is also grounds for immediate account termination.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a JiffyNet Hosting server or using an email address that is maintained on a JiffyNet Hosting server for this purpose is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.

JiffyNet Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honored. Jiffynet Hosting has allocated tools to ensure proper delivery of opt-in opt-out mailing lists and normal email. It is important that you use these tools accordingly. All full packages include access to the pre-installed Mailman Mailing List Software. Large mailing lists, (those exceeding 500 subscribers) sent using the Jiffynet Hosting Services, must be sent using the mailing list tools that have been pre-installed for this purpose. If your mailing list exceeds 1,500 addresses you should contact Jiffynet Hosting requesting permission to send the mailing through the Jiffynet Hosting servers prior to sending any messages. Sending a large mailing through mailing list software other than Jiffynet Hosting's pre-installed software can adversely affect the flow of email. Should such a large mailing disrupt normal services or create unacceptable server loads, the account associated with the mailing risks termination. All accounts may only have one mailing list. Running more than one mailing list on your account risks suspension and termination of services.

Please make an effort to send out large mailings from the hours of 12AM - 8AM EST.

Server Abuse:
Any attempts to undermine or cause harm to a JiffyNet Hosting server or customer of JiffyNet Hosting is strictly prohibited. JiffyNet Hosting will pursue legal action to the fullest extent for all abuse of the JiffyNet Hosting Network.

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. JiffyNet Hosting reserves the right to remove any account without prior notice. If JiffyNet Hosting deactivates your account(s) for violating policy, your will forfeit your rights to a refund...and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Use of Jiffynet Hosting Service constitutes acceptance and agreement to Jiffynet Hosting's AUP as well as Jiffynet Hostings TOS (Terms of Service)

Jiffynet Hostings reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service). All users of Jiffynet Hostings Internet services, and their clients, must comply with this AUP and our TOS (Terms of Service).
